»Private Legal Protection against the Abuse of Market Power« The design of civil legal consequences of violations of prohibitions of the abuse of market power is of considerable importance for the private enforcement of antitrust law. The paper investigates for the practically most important case groups of abusive behavior both European and German antitrust law, the design of legal consequences of prohibited legal transactions, of entitlements of market participants and of the content of injunction relief and of removal and damage claims. For the implementation of private enforcement effective sanctions and legal protection are required. Given the extent of the concept of abuse of market power but a differentiated approach is needed. For each of the case group appropriate solutions have to be found, considering the objective of the respective prohibition of conduct, the legitimate interests of the market participants concerned, of classification by civil law and practical handling. To this the book offers a systemic analysis.
