The comprehensive analysis highlights the historic development of § 177 StGB (German Criminal Code) and involves interdisciplinary findings (for example from psychology). On this basis the paper critically discusses the current legal situation. It becomes evident that stereotype beliefs lead to a restrictive interpretation neglecting the victim's point of view. Therefore a new understanding of § 177 StGB is necessary and in addition the sanction of all non consensual sexual acts.
